Policies, Procedures & Agreements

Taxes-All taxes are at the rates applicable at the time of the Rental Agreement.  Taxes will be disbursed to the taxing bodies, i.e. Brunswick County, Town of Oak Island, Caswell Beach or Southport, State of NC, upon termination of the tenancy or material breach of the agreement. Rental rates listed do not include the applicable taxes.

Property Protection Plan-A $45.00 non-refundable property protection plan for each property rented is included with every rental. Accidental damage protection is included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period up to $1500.00. Any damage or accident that is not covered under the policy will be the responsibility of the leaseholder.

Optional Travel Protection Insurance-Better Beach Rentals offers optional Travel Guard Travel Insurance under Section 42A-36 of the VRA. Under order of mandatory evacuation, if the tenant refused insurance that would have compensated the tenant for losses or damage resulting from the loss of the use of the property, the tenant would not be entitled to a refund. A copy of Travel Guard coverage will be mailed to you with your confirmation. Coverage must be selected and paid for with your 1st payment.

House Parties/Minors-We reserve the right to refuse occupancy, if in the agent’s opinion occupancy is detrimental to the property. We do not rent to groups planning house parties, etc., only families, couples and responsible adults 24 years and older. Better Beach Rentals reserves the right to refuse rental to minors (under 24 years old) without chaperones. An adult chaperone must be present at all times. If minors are found un-chaperoned, they will be asked to leave the premises with no refund of rental monies.

Smoke Detectors-North Carolina statutes require all tenants to check smoke detector operation upon arrival and to notify, in writing, the Better Beach Rentals office of any malfunctions.

Construction-Better Beach Rentals cannot predict construction plans in the area and, therefore, cannot be responsible for construction occurring near any rental property. No request for compensation or move to another property due to nearby construction will be considered.

Rental Properties under Construction-Reservations placed on homes that are under construction cannot be guaranteed to be completed by the date of the reservation. If a new construction home is not completed by the check-in date, Better Beach Rentals will either move the guest to a comparable property or refund all monies paid on that particular reservation. Furthermore, amenities listed on advertisements for new construction properties can change without notice due to the nature of furniture chosen by the specific homeowner. No extra compensations will be given to a guest if the property is not ready for rental or if specific amenities are different than advertised. Guests rent these properties with the understanding that sometimes construction can exceed the estimated time frame.

Maintenance/Repairs/Nuisances-Better Beach Rentals cannot guarantee the operation of any home amenities. Please report any equipment malfunction. We will make every effort to respond to any appliance or equipment problems. No refunds or partial rental deposits will be made for a malfunctioning appliance or amenity or for other items outside of our control, such as bad weather or a home not decorated/furnished to personal taste. In the event that there isn’t any electricity, water, or A/C (only these items), we will move you to another available property until the problem is remedied.  At that time, we will move you back to your original rented property.  No refunds are to be issued but Better Beach Rentals will do it’s best to fix the problem in a timely manner.

Condition of Property-Every property we manage is privately owned and reflects each owner’s personal taste. Every effort has been made to represent each property as realistically as possible with regard to space, physical condition, distances to beach accesses, and comparisons. If you have specific personal requirements, please discuss these with a Better Beach Rentals agent.

Grills-Grilling on decks, porches, and balconies is prohibited by local fire ordinances. If you wish to use a grill, please place the grill on concrete or other stable surface at least 10 feet from the property.

Firearms-Firearms are not allowed on any property.

Fireworks-Fireworks of any kind are prohibited at vacation rental properties.

Hot Tub Rentals and Window Air Conditioners-No temporary hot tubs may be placed on the property at any time. No window air conditioners may be placed in the property without express written permission of the Agent and Owner.

Lost and Found-Any personal property left in the rental property will not be the responsibility of Better Beach Rentals; every effort will be made to return them to you at your expense. There is a minimum charge of $25.00 for retrieving and shipping any items back.

Keys-Two sets of keys will be issued to the tenant(s) who name(s) appear on the Vacation Rental Agreement. A minimum $10.00 per key charge will be applied and deducted from the security deposit for all unreturned keys.

Lock out-If you have lost, misplaced or forgotten the keys for your rental property, you may contact Better Beach Rentals during normal business hours or call our emergency number after hours for assistance.

2015 Reservations-Current guests have first priority to reserve the same property during the same rental week for next year.  While you are here, make your plans for 2015 by 5:00 pm on the Wednesday of your rental week.  If you do not place your hold by that time, the property will be eligible for re-rental on the following Thursday at 8:30 am. A non-refundable /non-transferable Hold Fee of $50.00 plus tax must accompany your reservation.  Courtesy reservations made without payment will be cancelled upon your week’s departure.  This fee is not applied toward your rent.

Prepayments-Guests will have the option to choose two different payment plans at the time of making a reservation for a non-refundable fee of $25.00. “Plan A” requires a fifty percent (50%) rental prepayment and the balance payment due 30 days prior to arrival. “Plan B” requires a twenty-five percent (25%) rental pre-payment of the total reservation, with equally divided monthly installments, that will be automatically debited to the card used for your down payment, until it is paid in full the 1st of the month prior to arrival. If Better Beach Rentals does not receive such down payment for either plan the same day of making a reservation, your reservation will be cancelled. If making a reservation within 30 days of arrival, full payment is due at the time of making the reservation.  Better Beach Rentals accepts Debit cards, as well as VISA, MasterCard, American Express and Discover cards.  No personal checks will be accepted at time of check-in for rent, security deposit or other fees of any kind.

Check In/Check Out-Check in begins at 3 pm.  Our goal is to have all properties ready for occupancy by that time.  If you arrive early, please do not go to the home.  Our cleaning crews will not stop at the home if a car is present.  This may delay your check-in time.  Better Beach Rentals offers an early check-in at 1pm for a limited number of homes.  This service is available for an additional fee of $50.00 plus tax.  Check out is no later than 10:00AM.  We’re sorry, but no exceptions can be made as we must have time to prepare the home for arriving guests.  Late check out will incur a $50 late fee until 1pm.  After 1pm, a one night rental charge will be incurred.

Cancellations by Guest-Cancellations by guest must be in writing. If the property is re-rented, the guest will receive the advance rent payment back less a $50.00 cancellation fee. If the property is not re-rented, the guest will not be entitled to reimbursement for any advance rent payment. Agent will not be responsible for reimbursing any 3rd party fees that have already been paid out, and the guest must seek reimbursement directly from the third party.

Cancellations by Better Beach Rentals-If your home becomes unavailable outside 180 days prior to your check-in date, (change in ownership, taken off rental market, owner schedule change, etc.) we will make every effort to find an acceptable substitute home. We will notify you of the change as soon as we become aware of it, and if we are unable to find an acceptable home for you, we will refund 100% of your deposit. The management firm, on behalf of the home owner, reserves the right to cancel this agreement at any time prior to tenant taking possession of the property. In such event, all payments made by the guest to the management firm will be refunded, and neither management nor owner will be liable for any damages of any sort incurred by tenant as a result of such cancellation. If guest desires to be placed in an alternative home, the management firm will make a good faith effort to relocate the guest, but if the home selected is more expensive, guest agrees to pay the difference.

Transfer-Section 42A-19(a) provides that if the property is voluntarily transferred by the owner, guest has the right to enforce the Vacation Rental Agreement (VRA) against the grantee of the property if the vacation is to end 180 days or less after the date the grantee’s interest in the property is recorded in the Register of Deeds Office.  If the vacation rental is to end more than 180 days after recordation of the grantee’s interest in the property, the guest has no right to enforce the terms of the agreement unless the grantee agrees in writing to honor the agreement, but the guest is entitled to a full refund of any payments he or she has made. Within 10 days of a property transfer, each guest will be notified in writing of the property transfer, the grantee’s name and address, and the date the grantee’s interest was recorded. If the owner’s interest in involuntarily transferred to another, prior to the guest’s occupancy of the property, the Agency shall refund to the guest any payments made by the guest within 60 days after the transfer.

Rights and Obligations-Pursuant to 42A-17(b) of the VRA, if at the time the guest is to begin occupancy of the property, the owner or agent of the owner cannot provide the property in a fit and habitable condition or substitute a reasonable comparable property in such condition, the owner or agent shall refund to the guest all payments made by the guest.

Advance Payment Uses-Pursuant to section 42-16 of the VRA, agent acting on behalf of owners may disburse prior to occupancy of the property up to 50% of the total rent paid in advance for fees owed to third parties for goods, services or benefits processed by the owner or agent on behalf of owners for the benefit of the guest, including administrative fees set forth in paragraph 10 below. Any Funds remaining after and advance disbursement shall be retained in its trust account and not disbursed until the occurrence of the first of the following events: (1) the commencement of tenancy (2) the guest commits a material breach, in which case an amount sufficient to defray actual damages suffered as a result of the breach: (3) the money is refunded to the tenant: or (4) if the funds are transferred upon the termination of the owner’s interest in the property.

Fees-(a) There is a $25.00 returned check fee: (b) a $25.00 late payment fee: (c) a late check out fee of $50.00 until 1pm: (d) Better Beach Rentals charges $45.00 non-refundable reservation fee plus tax. As the agent handling rental insurance, we receive one (1%) of the insurance cost as a processing fee. 

Mandatory Evacuation-If the state or local authorities, acting pursuant to Article 36A of chapter 14 or article of Chapter 166A of the General Statutes, order a mandatory evacuation of an area that includes the residential property subject to a vacation rental, the guest in possession of the property shall comply with the evacuation order. The guest shall not be entitled to a refund if prior to guest taking possession of the property, the guest refused insurance offered by Better Beach Rentals that would have compensated him or her for losses or damage resulting from loss of use of the property due to a mandatory evacuation order. The insurance offered shall be provided by an insurance company duly authorized by the NC Department of Insurance and the cost of the insurance shall not exceed 8% of the total rent charged for the vacation rental to the guest.

Event Fees- If you are planning on having an event at the property you are renting, there is a $500.00 event fee. If you do not disclose your plans of having an event prior to check-in, and you have an event at the property, you will then be charged the event fee, a $250.00 fine, and will be asked to leave the premises of the rental property immediately with no refund awarded.

Occupancy Limits-You are responsible for knowing and respecting the occupancy limits in your home. These occupancy limits are determined by local health departments and are based on septic tank capacity. If you are unsure of how many people can sleep in your home, please call our office. No campers, tents, or motor homes may be used in conjunction with a rental unit to increase capacity. Guests who exceed the occupancy limits will face immediate termination of the rental with no refund of rental monies.

Pet Friendly Homes/Dogs Only-Dogs are allowed only in designated properties shown by a symbol of a dog. Only one dog per household unless previously approved by homeowner. A non-refundable $150 pet fee plus tax will be required before check-in. This pet fee is for a flea treatment and/or the extra cleaning required. If a pet is found on a premise that does not allow pets, your rental right will terminate immediately with no refund of rental monies and you will also be required to pay for a flea treatment. This policy is strictly enforced.

Smoking Policy-All of Better Beach Rentals’ properties maintain a smoke-free policy. No smoking or other use of tobacco products is permitted. This includes, but is not limited to, pipes, cigars, snuff, or chewing tobacco. Smoking is strictly prohibited inside any property rented through this company. When smoking outside, do not leave cigarette butts on the ground or anywhere else. Dispose of them properly in appropriate receptacles outside. This policy applies to all guests, as well as their visitors. Individuals whom violate this policy will be charged a fee of $250.00.
